Terms and conditions
What applies when you book with us – booking, payment, cancellation, arrival and house rules.
1. Scope
These terms apply to all accommodation contracts between Luxescape GmbH, Feldweg 14, 9562 Himmelberg, Austria (“the landlord”) and the guest concerning the holiday apartments offered on this website. Where you book through a booking portal, that portal’s terms apply in addition.
2. Conclusion of contract
Your enquiry by e-mail, phone, WhatsApp or through the booking calendar is not yet a booking. The contract is concluded when we confirm your booking in writing, usually by e-mail. The confirmation states the property, the dates, the number of guests, the total price and the address. Please check it and report any discrepancy within three days.
3. Prices and local tourist tax
The prices shown in the booking calendar at the time of booking apply, in euros and including statutory VAT. Bed linen and towels are included; at Lake Ossiach please bring your own shower and bath towels.
The local tourist tax is added to the room rate. It is set by the regional tourism board, not by us, and may change.
Final cleaning: insert amount · Dog surcharge: insert amount per dog and night. Dogs are not permitted in apartment No. 2.302 Alpenblick.
4. Payment

5. Arrival and departure
Check-in from insert time, check-out by insert time. Key handover: insert procedure. Different times are possible by arrangement, subject to occupancy.
6. Cancellation by the guest
Cancellations must reach us in writing. insert cancellation scale
If we find a replacement guest on the same terms, we charge only a handling fee of insert amount instead. No refund is due for early departure. We recommend travel cancellation insurance.
7. Cancellation by the landlord
We may withdraw if the deposit is not paid despite a reminder, if force majeure makes use impossible, or if the booking was made on misleading information. Payments already made are refunded without delay.
8. Use of the property
Only the number of guests stated in the confirmation may stay. Subletting is not permitted. Please report any damage immediately. Smoking is not permitted. delete if not applicable Parties and events are not possible out of consideration for the neighbours.
9. Pets
Dogs are welcome in some of our properties by prior arrangement and against a surcharge. Dogs are not permitted in apartment No. 2.302 Alpenblick. Dogs may not go on beds or upholstered furniture and may not be left unattended. You are liable for damage caused by your animal.
10. Liability
We are liable under statute for intent and gross negligence. For slight negligence we are liable only for breach of essential contractual duties, limited to foreseeable damage typical of the contract. Liability for personal injury is unaffected. Use of the sauna, playground and parking is at your own risk. We are not liable for third-party services such as cable cars, ski schools and restaurants; their opening times are seasonal.
11. Registration requirement
Under the Carinthian registration act we must register all guests. Please complete the guest form on arrival and have an identity document ready. This data goes only to the registration authority and the tourism board.
12. No right of withdrawal in distance selling
Important: For accommodation contracts for a specific date there is no statutory right of withdrawal under section 18(1)(10) of the Austrian Distance and Off-Premises Business Act (FAGG). This also applies to online bookings. Only the cancellation terms under point 6 apply.
13. Complaints
If something is not right during your stay, please tell us at once on +43 664 3458434. We cannot remedy a problem we only learn about after departure.
14. Final provisions
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods and conflict-of-law rules. Mandatory consumer protection rules of the guest’s country of habitual residence remain unaffected. Place of performance is the location of the property. The EU online dispute resolution platform is available at ec.europa.eu/consumers/odr; we are neither obliged nor willing to take part in consumer arbitration.
